1. INTRODUCTION
These Terms & Conditions (“Terms”) govern access to and use of the Thuru Kepakaru mobile application, website, related digital platforms and services (collectively, the “Platform”), and participation in the Thuru Kepakaru Programme (the “Programme”).
Thuru Kepakaru is an environmental and corporate social responsibility initiative intended to encourage tree planting, long term tree care, environmental responsibility and community participation by assigning participants a stewardship role in caring for trees and monitoring their progress.
The Programme is conducted by S-lon Lanka (Pvt) Ltd. (“S-lon”) and may be implemented in collaboration with schools, government institutions, corporate partners, sponsors and other participating organisations.
2. DEFINITIONS
For purposes of these Terms:
2.1 “Application”
Means the Thuru Kepakaru mobile application, web application and any updated or successor application.
2.2 “Programme”
Means the Thuru Kepakaru tree planting and tree care initiative and any associated campaigns, activities or projects.
2.3 “User Content”
Means photographs, descriptions, comments, planting information, tree information and other material submitted by a User through the Platform.
3. ACCEPTANCE OF TERMS
3.1 Acceptance
By accessing, registering for, or using the Platform, or by participating in the Programme through the Platform, you acknowledge that you have read, understood and agree to be bound by these Terms.
3.2 Privacy Policy
Your use of the Platform is also subject to the applicable Thuru Kepakaru Privacy Policy, which explains how personal information is collected, used, stored, disclosed and otherwise processed.
The Privacy Policy forms a separate part of the Programme's legal framework and should be read together with these Terms.
4. ELIGIBILITY
4.1 General Eligibility
Participation is open to persons who meet the eligibility requirements established for the relevant Programme activity.
4.2 Accurate Information
Participants must provide accurate and complete information where information is required for registration or Programme participation.
4.3 Minors
Where the Programme is made available to persons under the age of 16, participation shall be subject to the consent, supervision or authorisation mechanism specified by the S-lon Lanka (Private) Limited.
Depending on the activity, such mechanism may involve a parent or legal guardian, school, teacher, or other authorised adult.
A minor should not be required to independently provide consent to contractual or data processing arrangements where applicable law requires parental or guardian involvement.
5. REGISTRATION AND USER ACCOUNTS
5.1 Account Registration
Certain Platform features may require the creation of a User account.
5.2 Verification
The Platform may use OTPs, authentication mechanisms, institutional verification or other methods to verify accounts.
6. THE THURU KEPAKARU PROGRAMME
6.1 Programme Purpose
The Programme is intended to encourage participants to

plant saplings
-
care for planted trees
-
monitor tree growth
-
develop long term environmental responsibility ,and
-
contribute to environmental awareness and community participation.
6.2 Permission to Plant
Participants are responsible for ensuring that they have the necessary permission to plant and maintain trees at locations under their control or responsibility.
A participant must not plant a tree on private, public, protected or other property without appropriate permission.
7. USER CONTENT, PHOTOGRAPHS AND MEDIA
7.1 User Responsibility
Users are responsible for ensuring that they have the necessary rights and permissions to submit User Content.
7.2 Rights of Others
Users must not submit photographs, videos or other content in a manner that unlawfully infringes another person's privacy, intellectual property rights, image rights or other legal rights.
7.3 Images of Children
Where photographs include children or other identifiable persons, appropriate consent or authorisation must be obtained in accordance with applicable requirements and Programme procedures.
7.4 Content Removal
The Programme operator may remove or restrict User Content that violates these Terms, applicable law, Programme requirements or the rights of others.
8. POINTS AND REWARDS
8.1 Points
The Platform may award Points based on participation and continued care of registered trees.
8.2 Points Criteria
Points may depend on factors such as

tree registration
-
continued care
-
submission of progress information
-
verification, and
-
other criteria announced by the Programme.
8.3 No Monetary Value
Unless expressly stated otherwise, Points
-
are not money
-
are not a financial asset
-
cannot be sold or transferred, and
-
do not represent a monetary claim against the Programme operator.
8.4 Fraudulent Points
Points obtained through fraud, manipulation, duplicate records, false information or other prohibited conduct may be cancelled.
8.5 Rewards
Where rewards or recognition are offered, eligibility, selection criteria and reward conditions will be communicated for the relevant Programme activity.
Unless expressly guaranteed, participation or accumulation of Points does not guarantee receipt of a particular reward.
9. INTELLECTUAL PROPERTY
9.1 Platform Ownership
Subject to User Content and third party rights, the Platform, software, design, graphics, databases, text, logos, trademarks and other Programme materials are owned by or licensed to the relevant Programme operator or its licensors.
9.2 Project Data
The compilation, structure and database of Programme information may be protected by applicable intellectual property or other rights.
Users must not systematically reproduce or commercially exploit Programme databases without authorisation.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, the Programme operator will not be responsible for losses arising solely from

inaccurate information submitted by a User or third party
-
failure of a tree or sapling to survive
-
unauthorised use of a User account caused by the User's failure to protect account credentials
-
loss or damage arising from a User's unlawful or prohibited activities, or
-
events outside the Programme operator's reasonable control.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
Nothing in these Terms is intended to exclude liability for fraud, wilful misconduct, death or personal injury where such exclusion is prohibited by applicable law, or any other liability that cannot legally be excluded.
11. INDEMNIFICATION
To the extent permitted by applicable law, a User may be responsible for losses, claims, liabilities, costs or reasonable expenses incurred by the Programme operator as a result of the User's

material breach of these Terms
-
fraudulent use of the Platform
-
unlawful conduct
-
infringement of third party intellectual property rights
-
unauthorised use of another person's personal information
-
submission of unlawful User Content, or
-
intentional misuse of Programme systems.
The extent of any indemnification obligation shall be subject to applicable law and the circumstances of the relevant claim.
12. CHANGES TO THESE TERMS
These Terms may be updated from time to time to reflect

changes to the Programme
-
changes to the Platform
-
legal or regulatory requirements
-
new features
-
changes to participation rules, or
-
operational requirements.
13. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and interpreted in accordance with the laws of Sri Lanka
Subject to applicable law, disputes arising from or relating to these Terms or the use of the Platform shall be subject to the jurisdiction of the courts of Sri Lanka.
Before commencing formal proceedings, the parties should make reasonable efforts to resolve disputes through the Programme operator's complaint or dispute resolution process.
